Under 49 CFR Part 382, all motor carriers must maintain a comprehensive drug and alcohol testing program for drivers operating commercial motor vehicles requiring a CDL. This isn't optional — it's a federal requirement with severe penalties for non-compliance.
The required testing categories include pre-employment drug testing before any driver operates a CMV, random testing throughout the year (minimum 50% of drivers for drugs, 10% for alcohol), post-accident testing following qualifying accidents, reasonable suspicion testing when a trained supervisor observes signs of impairment, return-to-duty testing after a positive test, and follow-up testing as prescribed by a Substance Abuse Professional.
Additionally, since January 2020, carriers must query the FMCSA Drug & Alcohol Clearinghouse before hiring any driver and conduct annual queries for all current drivers. This database tracks positive tests, refusals, and return-to-duty status across the entire industry.
