DOT Drug and Alcohol Testing Requirements
Under 49 CFR Part 382, all motor carriers must maintain a comprehensive drug and alcohol testing program for drivers operating commercial motor vehicles requiring a CDL. This isn't optional — it's a federal requirement with severe penalties for non-compliance.
The required testing categories include pre-employment drug testing before any driver operates a CMV, random testing throughout the year (minimum 50% of drivers for drugs, 10% for alcohol), post-accident testing following qualifying accidents, reasonable suspicion testing when a trained supervisor observes signs of impairment, return-to-duty testing after a positive test, and follow-up testing as prescribed by a Substance Abuse Professional.
Additionally, since January 2020, carriers must query the FMCSA Drug & Alcohol Clearinghouse before hiring any driver and conduct annual queries for all current drivers. This database tracks positive tests, refusals, and return-to-duty status across the entire industry.

What Happens When There's a Positive Test
A positive drug or alcohol test triggers a specific process that must be followed exactly. The driver is immediately removed from safety-sensitive duties, and the result is reported to the Clearinghouse.
SELAM guides you through every step: providing the driver with a list of Substance Abuse Professionals (SAPs), tracking the return-to-duty process, coordinating return-to-duty testing, and managing the follow-up testing schedule prescribed by the SAP. Do I need a drug consortium as a single owner-operator?
Yes. Every CDL driver, including a one-truck owner-operator, must be enrolled in a random testing pool (consortium) and registered in the FMCSA Clearinghouse with an annual query. SELAM enrolls you and runs the queries.
What percentage of drivers must be randomly tested each year?
FMCSA requires random drug testing at a minimum annual rate of 50% of the average number of driver positions, and random alcohol testing at a minimum annual rate of 10%. SELAM ensures your random selections meet or exceed these rates throughout the year.
What is the FMCSA Clearinghouse and do I need to use it?
The FMCSA Drug & Alcohol Clearinghouse is a federal database that tracks drug and alcohol testing violations. All employers must query the Clearinghouse before hiring a CDL driver (full query) and annually for all current drivers (limited query). SELAM handles all Clearinghouse queries for you.
What happens if I don't have a drug testing program?
